Gabriel Aubry has taken out a restraining order against Olivier Martinez after a Thanksgiving brawl that landed the model in the hospital and got him arrested.
As Gossip Cop previously reported, the two men had aviolent clash at Halle Berry’s home last Thursday, though there are differing accounts as to who started the altercation.
But according to Aubry’s court filing, it was Martinez who not only initiated the fight, but also threatened to kill him.
Aubry alleges tensions began rising at daughter Nahla’s school on Wednesday, where he claims Martinez whispered in his ear in French, “I wish I could beat the s**t out of you right now. You’re lucky we’re in a school right now. We’re going to take Nahla right now and you’re not going to follow us.”
At Berry’s home the following day, he says it was Martinez who greeted him as he attempted to drop off Nahla, instead of the nanny.

After Martinez told him,”We need to talk,” the actor allegedly jumped off the steps and brutally beat Aubry, slamming his head into the concrete driveway.
According to Aubry, Martinez screamed throughout the incident that their failed court battle over whether Berry and Nahla could move to France cost them $3 million — and that they intended to move anyway and Aubry better follow or he’d allegedly be killed.
It’s further alleged that Martinez revealed they called the cops and told Aubry, “You’re going to tell them that you’re the one who attacked me, or I’m going to kill you.”
Aubry, who claims the judge in the custody case ordered him and Berry to arrange 50/50 care for Nahla, suffered significant injuries in the fight, and attached photos of his badly bruised and swollen face to his declaration, says TMZ.
Aubry was arrested after the brawl, and Berry has since obtained an emergency restraining order, barring him from coming near her, Martinez or Nahla.
Gossip Cop hears it was Aubry who instigated the attack on Martinez, who suffered a hand injury in the incident.
